<br />I <br /> <br />I <br /> <br />I <br /> <br />110. <br /> <br />RESOLUTION NO. 2004- 220 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A DEVELOPMENT AGREEMENT BETWEEN <br />THE CITY AND ED LONGCOPE CONCERNING THE BLANCO <br />PARK SUBDIVISION; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Ed Longcope (the "Property Owner") is the owner of the tract of land in San Marcos, <br />Texas, to be platted as the Blanco Park Subdivision. <br /> <br />2. The City Planning and Zoning Commission approved a Final Plat for the Subdivision on <br />May 11,1999. <br /> <br />3. The Property Owner desires to record the Plat to enable the sale of lots within the <br />Subdivision. <br /> <br />4. The City's development regulations would normally require the Property Owner to <br />construct perimeter road improvements in connection with the platting of the Property. However, <br />there are special circumstances present, including a proposed project by the City to improve River <br />Road, and a proposed project by the Lower Colorado River Authority to relocate electric <br />transmission line poles, that create a need to address the Property Owner's responsibilities for road <br />improvements in a manner that will integrate with the River Road Project and the LCRA project. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The terms and conditions of the attached agreement between the City and the <br />Property Owner are approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the attached agreement <br />on behalf of the City. <br /> <br />PART 3.
