53. RESOLUTION NO. 2004_184R I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A MEMORANDUM OF UNDERSTANDING WITH MR. JOHN Q. HAMMONS, TRUSTEE REGARDING A PROPOSED HOTEL AND CONFERENCE CENTER PROJECT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. Mr. John Q. Hammons, Trustee ofthe John Q. Hammons Revocable Trust dated December 28, 1989, has proposed a public-private partnership with the City of San Marcos for the development of a resort hotel and conference center in San Marcos; and 2. The City Council, City staff, and retained attorneys are negotiating the terms under which the hotel and conference center would be constructed, maintained, and operated; and 3. The City Council adopted a resolution on July 26, 2004 expressing its support for the development of a hotel and conference center in San Marcos; and I 4. The City Council wishes to approve a Memorandum of Understanding with Mr. John Q. Hammons, Trustee of the John Q. Hammons Revocable Trust dated December 28, 1989, for the hotel and conference center project, to set the foundation for negotiation of definitive agreements for the financing, construction, operation and management of the hotel and conference center; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Memorandum of Understanding between the City of San Marcos and Mr. John Q. Hammons, Trustee of the John Q. Hammons Revocable Trust dated December 28, ] 939, for the development of a hotel and conference center project is approved. PART 2. The City Manager, Dan O'Leary, is authorized to execute the Memorandum of Understanding on behalf of the City. PART 3. This resolution is effective immediately upon adoption.
