Section 2.366 of the City Code establishes a five-member Animal Shelter Advisory <br />Committee, in accordance with the requirements in Texas Health and Safety Code 9823.005, that <br />includes one City resident as a member. <br /> <br />2. The City Council wishes to revise the composition of this committee so that a resident of <br />either the City or the City's extraterritorial jurisdiction can serve as a member. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 2.366 of the City Code is amended as follows (underlining indicates <br />added text): <br /> <br />Sec. 2.366. Established; appointment; terms. <br /> <br />The animal shelter advisory committee is established, in accordance with state law. The <br />committee will consist of one licensed veterinarian, one city official, one person whose duties <br />include the daily operation of an animal shelter, one representative from an animal welfare <br />organization, and one resident of the city or the city's extraterritorial jurisdiction. The committee <br />will be appointed by the city council for staggered terms of three years. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4. The importance of this Ordinance creates an emergency and an imperative <br />public necessity, and the provisions of the Charter requiring that ordinances be presented at three <br />separate meetings, and that ordinances do not take effect until ten days after the date of final passage <br />are suspended, and this Ordinance will take effect upon publication of notice of its adoption in a <br />newspaper of general circulation within the City. <br />
