The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on September 13. 2004 and on September 20. 2004 , to consider the proposed annexation by the City of 11] 4] acres, more or less, located in the 2300 - 3000 blocks of Old Bastrop Highway (HIgh School Tract), in Hays County, Texas (the "Annexation Area"), consisting of the tract of land described by metes and bounds in the attached Exhibit A. 2. The City has received a petition for annexation from the owner(s) of the property included in the Annexation Area, a copy of which is attached as Exhibit B. 3. An on-site public hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on August 31. 2004 and September 10. 2004 , these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet website on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the web site until the dates of the respective hearings. 5. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Annexation Area. 6. The proposed service plan was made available for Inspection and explained to the residents, if any, of the Annexation Area at the public hearings, 7. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 8. The armexation of the Annexation Area would cause an area to be surrounded to be surrounded by the City and not included within the city limits, and the City Council finds and determines that this is in the public interest on the basis that the area to be surrounded by the City
