74. ~~ en ...".. 0 oj 0 ~E 0 a:ra W~ C"'J w~ I ....-I -'e: -oJ .u ....-I ura ~ >rn (.!:J 1-- ;::) -0 ~ <( u~ 0 ORDINANCE NO. 2004- 78 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 13.49 ACRES, MORE OR LESS, LOCATED TO THE NORTHEAST OF THE PROPOSED COTTONWOOD CREEK DEVELOPMENT IN THE 2500-4500 BLOCKS OF STATE HIGHWAY 123 SOUTH (COTTONWOOD CREEK TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on Septemh~T 11. 1004.and on September 20. 2004, to consider the proposed annexation by the City of 13.49 acres, more or less, located to the northeast of the proposed Cottonwood Creek development in the 2500-4500 blocks of State Highway 123 South, in Hays County, Texas, consisting of the tract of land described by metes and bounds in the attached Exhibit A (the "Annexation Area"). I 2. The City has received a request for annexation from the owner of the property included in the Annexation Area, a copy of which is attached to this ordinance as Exhibit B. 3. An on-site public hearing has not been requested in writing by more than 10% of the adults who are pennanent residents of the Almexation Area. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on Au~ust 31. 2004 and September 10. 2004, these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet web site on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the website until the dates of the respective hearings. 5. Prior to the publication of the notices of the public hearings, the City Council directed preparation of a service plan that provided for the extension of municipal services to the Annexation Area. 6. The proposed service plan was made available for inspection and explained to the residents, if any, of the Annexation Area at the public hearings. 7. The Annexation Area is contiguous and adjacent to the current boundaries of the City. I 8. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the Annexation Area, including public hearings and the vote(s) on adoption of this
