(j AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REVISING FEES FOR BUILDING INSPECTIONS DIVISION SERVICES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. ORDINANCE NO. 2004- 79 -~ = to- U C RECITALS: 1. The Building Inspections Division of the Planning and Development Services Department has reviewed the current fee structure and determined that current fees do not reflect the actual costs associated with providing these special services, and has recommended revisions to these fees to recover more of the costs of providing the services. 2. The City Council wishes to implement the fee increases recommended by the Building Inspections Division. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The schedule of fees for Building Inspections Division services attached to this ordinance as Exhibit A is approved. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
