<br />I <br /> <br />I <br /> <br />I <br /> <br />84. <br /> <br />RESOLUTION NO. 2004-~R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF AN AGREEMENT BETWEEN THE CITY AND <br />HAWES HILL CALDERON, LLP FOR PROFESSIONAL <br />SERVICES IN CONNECTION WITH THE PROPOSED BLANCO <br />VIST A TAX INCREMENT REINVESTMENT ZONE; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. At its October 25th meeting, the City Council directed the staff to proceed with the <br />establishment of a tax increment reinvestment zone (TIRZ) for the Blanco Vista development north <br />of the City near the Blanco River, on the west side of Post Road. <br /> <br />2. Mr. Bill Calderon, with the firm of Hawes Hill Calderon, LLP of Houston, has performed a <br />preliminary analysis of the feasibility of the TIRZ to finance the cost of constructing a railroad <br />overpass to extend Yarrington Road to the Blanco Vista development. <br /> <br />3. The City Council wishes to engage the firm of Hawes Hill Calderon, LLP to perform <br />consulting services related to the TIRZ, on condition that the developer of Blanco Vista, Carper- <br />Carma Properties No.1, Ltd., deposit the cost for these services with the City, to be repaid from <br />TIRZ revenues if the zone is successfully established, and if the formation of the zone is not <br />finalized, the developer will bear the cost. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The attached agreement between the City of San Marcos and Hawes Hill Calderon, <br />LLP for consulting services related to the formation of a TIRZ for the Blanco Vista development is <br />approved, on the condition that the developer of Blanco Vista, Carper-Carma Properties No.1, Ltd., <br />deposit the cost for these services with the City, to be repaid from TIRZ revenues if the zone is <br />successfully established, and if the formatIOn of the zone is not finalized, the developer will bear the <br />cost.. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the agreement on behalf <br />of the City after the deposit described in Part 1 is made with the City. <br /> <br />P ART 3. This Resolution is in full force and effect immediately from and after its adoption. <br /> <br />ADOPTED on November 8, 2004. <br />
