<br />I <br /> <br />I <br /> <br />I <br /> <br />97. <br /> <br />RESOLUTION NO. 2004- 193 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDED CONTRACT <br />BETWEEN THE CITY AND THE SAN MARCOS HISP ANIC <br />CHAMBER OF COMMERCE FOR THE PROVISION OF TOURISM <br />PROMOTIONAL SERVICES DURING THE CITY'S 2004-2005 <br />FISCAL YEAR; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THIS CONTRACT; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECIT ALS: <br /> <br />1. The State Legislature has authorized Texas cities to collect an occupancy tax on hotel and <br />motel rooms and has approved certain expenditures from the proceeds of this occupancy tax in <br />Chapter 351, Texas Tax Code. <br /> <br />2. The City Council of the City of San Marcos has levied a hotel occupancy tax in Article 5 <br />of Chapter 78 of the San Marcos City Code. <br /> <br />3. The City Council in a resolution adopted on September 27,2004, approved a contract with <br />the San Marcos Hispanic Chamber of Commerce for the administration of a portion of the funds <br />collected from the hotel occupancy tax for the purpose of providing tourism promotional services <br />during the City's 2004-2005 fiscal year. <br /> <br />4. The City Council wishes to approve an amended contract with the San Marcos Hispanic <br />Chamber of Commerce in place of the contract approved by the Council on September 27,2004. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The resolution adopted by the City Council on September 27, 2004, approving a <br />contract with the San Marcos Hispanic Chamber of Commerce for the administration of hotel <br />occupancy tax funds is repealed and rescinded. <br /> <br />PART 2. The budget ofthe San Marcos Hispanic Chamber of Commerce for the 2004-2005 <br />fiscal year, a copy of which is attached to the contract approved in Part 3 below, is approved. <br /> <br />PART 3. The attached Contract for Tourism Promotional Services between the City of San <br />Marcos, Texas and the San Marcos Hispanic Chamber of Commerce for the administration offunds <br />collected under Article 5 of Chapter 78 of the City Code and Chapter 351, Texas Tax Code, is <br />approved. <br /> <br />PART 4. The City Manager, Dan 0 'Leary, is authorized to execute this contract on behalf of <br />the City of San Marcos. <br /> <br />PART 5. This Resolution is in full force and effect from and after its passage. <br />
