ORDINANCE NO. 2004 - R1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE TO CHANGE THE 1000 BLOCK OF ADVANCE STREET FROM "NO PARKING ANYTIME" TO "NO PARKING ANYTIME - TOW AWAY"; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. The Traffic Register, required by Section 82.067 of the City Code of Ordinances needs to be amended to allow illegally parked cars to be towed from the 1000 block of Advance Street because the narrowness of the street prohibits access by emergency vehicles when cars are parked on the street. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: I SECTION 1. Pursuant to Section 82.066 of the City of San Marcos Code of Ordinances, the Traffic Register is amended to create a tow away zone for illegally parked cars in the 1000 block of Advance Street and change the attendant signage to "No Parking Anytime - Tow Away". SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This ordinance shall be in effect ten (10) days from and after its passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
