<br />I <br /> <br />I <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos (hereinafter called "GRANTOR"), is the fee <br /> <br />simple owners of the PROPERTY and have agreed to grant such easements to GBRA for the <br /> <br />consideration and upon the terms and provisions hereinafter set forth. <br /> <br />NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That for and in <br /> <br /> <br />consideration of the sum of TEN AND NO/lOO DOLLARS ($10.00) cash in hand and other <br /> <br /> <br />good and valuable consideration paid by GBRA to the GRANTOR, the receipt of which is <br /> <br /> <br />hereby acknowledged and confessed, and the compliance with and adherence to the terms and <br /> <br /> <br />conditions of this easement by GBRA, the GRANTOR does hereby grant unto GBRA, and <br /> <br /> <br />unto its successors and assigns, a perpetual easement for the purpose of constructing, <br /> <br />maintaining, operating, repairing, rebuilding, relocating, replacing and removing one pipeline <br /> <br />for the transportation of treated water on, over and across the PROPERTY. The easement <br /> <br />herein conveyed is limited to the PROPERTY, except that during the period of construction of <br /> <br />said pipeline, and for a period of six (6) months from the date of completion of said pipeline <br /> <br />within the PROPERTY, GBRA shall have the right to use an additional strip of land as a <br /> <br />temporary construction easement (companion temporary construction easement) as described <br /> <br />in Exhibit "A" attached hereto. <br /> <br />THERE IS EXPRESSLY RESERVED to the GRANTOR, its heirs and assigns, the <br /> <br />right to use fully all of the PROPERTY covered hereby for any purpose not inconsistent with <br /> <br />the rights granted to GBRA, its successors and assigns, which reserved rights in and to the <br /> <br />PROPERTY by the GRANTOR shall be at all times subject and subservient to the easement <br /> <br />rights granted hereunder, subject to the terms and conditions of this easement. <br /> <br />PIPELINE EASEMENT (Treated Water) 6/02 <br /> <br />Page 2 of 8 <br />
