I I I WHEREAS, the City of San Marcos (hereinafter called "GRANTOR"), is the fee simple owners of the PROPERTY and have agreed to grant such easements to GBRA for the consideration and upon the terms and provisions hereinafter set forth. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That for and in consideration of the sum of TEN AND NO/lOO DOLLARS ($10.00) cash in hand and other good and valuable consideration paid by GBRA to the GRANTOR, the receipt of which is hereby acknowledged and confessed, and the compliance with and adherence to the terms and conditions of this easement by GBRA, the GRANTOR does hereby grant unto GBRA, and unto its successors and assigns, a perpetual easement for the purpose of constructing, maintaining, operating, repairing, rebuilding, relocating, replacing and removing one pipeline for the transportation of treated water on, over and across the PROPERTY. The easement herein conveyed is limited to the PROPERTY, except that during the period of construction of said pipeline, and for a period of six (6) months from the date of completion of said pipeline within the PROPERTY, GBRA shall have the right to use an additional strip of land as a temporary construction easement (companion temporary construction easement) as described in Exhibit "A" attached hereto. THERE IS EXPRESSLY RESERVED to the GRANTOR, its heirs and assigns, the right to use fully all of the PROPERTY covered hereby for any purpose not inconsistent with the rights granted to GBRA, its successors and assigns, which reserved rights in and to the PROPERTY by the GRANTOR shall be at all times subject and subservient to the easement rights granted hereunder, subject to the terms and conditions of this easement.
