<br />I <br /> <br />I <br /> <br />I <br /> <br />WHEREAS, the undersigned (hereinafter called "GRANTOR"), is the fee simple <br /> <br />owners of the PROPERTY and has agreed to grant such easements to GBRA for the <br /> <br />consideration and upon the terms and provisions hereinafter set forth. <br /> <br />NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the <br /> <br />GRANTOR, for and in consideration of the sum of TEN AND NOnOO DOLLARS ($10.00) <br /> <br />cash in hand and other good and valuable consideration paid by GBRA to the GRANTOR, the <br /> <br />receipt of which is hereby acknowledged and confessed, do hereby grant unto GBRA, and <br /> <br />unto its successors and assigns, a perpetual easement for the purpose of constructing, <br /> <br />maintaining, operating, repairing, rebuilding, relocating, replacing and removing one (1) <br /> <br />pipeline, and one (1) pump station and related facilities for the transportation of treated water <br /> <br />on, over and across the PROPERTY of the GRANTOR described in Exhibit "A" attached <br /> <br />hereto. The right of way and permanent easement herein conveyed is described in Exhibit <br /> <br />"A" attached hereto, except that during the period of initial construction of said pipeline, <br /> <br />pump station and related facilities GBRA shall have the right to use an additional strip of land <br /> <br />as a temporary construction easement (companion temporary construction easement) as <br /> <br />described in Exhibit "A". <br /> <br />THERE IS EXPRESSLY RESERVED to the GRANTOR, its successors and assigns, <br /> <br /> <br />the right to use fully all of the PROPERTY covered hereby for any purpose not inconsistent <br /> <br /> <br />with the rights granted to GBRA, its successors and assigns, which reserved rights in and to <br /> <br />the PROPERTY by the GRANTOR shall be at all times subject and subservient to the <br /> <br />easement rights granted hereunder. <br /> <br />PIPELINE EASEMENT (Treated Water) 6/02 <br /> <br />Page 2 of 7 <br />
