Co <br />~ CJ ~ <br />U <br /> <br />"'<d- <br />= <br />= <br />C"-l <br /> <br />ORDINANCE NO. 2004- EJ4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 2.172 OF THE <br />CITY CODE TO CHANGE THE FREQUENCY WITH WHICH <br />THE SUNSET ADVISORY COMMISSION IS APPOINTED; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECIT ALS: <br /> <br />1. The Sunset Advisory Commission, in its June 14, 2004 report to the City Council, <br />recommended that the City Council change the time interval at which the Sunset Advisory <br />Commission is required to be appointed. <br /> <br />2. The City Council wishes to implement this recommendation of the Sunset Advisory <br />Commission. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 2.172 of the City Code is amended as follows (underlining indicates <br />added text; overstrike indicates deleted text): <br /> <br />Sec. 2.172. Composition; appointment of members; officers. <br /> <br />(a) The sunset advisory commission is established every-three five years, composed <br />of seven citizens of the city who are appointed by the city council for terms not to exceed 12 <br />months. <br /> <br />(b) The commission members will elect a chairperson and vice-chairperson within 30 <br />days after their appointment. The commission may elect from its membership other officers <br />and committees as it may, from time to time, determine necessary for the proper perfomlance <br />of its duties. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph ofthis ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4. This Ordinance will tal(e effect ten days after the date of its final passage, and <br />the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. <br /> <br />1 <br />
