I I I 85. mTERLOCALAGREEMENTFOR ROADWAY CONSTRUCTION Effective Date: September 30, 2004 Parties: The City of San Marcos (the "City"), the County of Hays (the "County"), and the San Marcos Consolidated Independent School District ("SMCISD"). Recitals: 1. The Interlocal Cooperation Act (Chapter 791, Texas Government Code) empowers the parties to contract with each other in the perfonnance of governmental :functions, including functions and services in the area of streets, roads and drainage. 2. The City, the County and SMCISD wish to cooperate in the process of designing and constructing an extension of McCarty Lane, improvements to County Road 266 (Old Bastrop Road) between McCarty Lane and State Highway 123, and improvements to the intersection of County Road 266 and State Highway 123. 3. The City, the County and SMCISD are willing to contnbute funding towards the costs of these improvements as descn"bed in this agreement. Agreement: In consideration of the mutual covenants and agreements contained herein, as well as other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, the City, the County and SMCISD agree as follows: Section 1. Term. The tenn of this agreement will commence on the Effective Date and will continue until the completion and acceptance of the improvements described in this agreement by the appropriate authorities having jurisdiction over them Section 2. General Description of Proposed Improvements. A. Realignment, upgrade and signa1i7ation ofSH 123/CR 266 (Old Bastrop Hwy.) intersection B. Upgrade of CR 266 to a 3-Jane section :from the 123 intersection south to the intersection with McCarty Lane (approximately 3700') C. Extension of McCarty Lane as a 3-lane section into the SMCISD's High School property (approximately 1650') Section 3. Contributions from Local Entities. A. County: Not to exceed $300,000 B. City: Not to exceed $300,000
