The Finance Department has recommended the reVISIOn of City Code Section <br />86.200 to include drainage utility service as a billed utility service, non-payment for which <br />can result in termination of all utility services. <br /> <br />2. The Finance Department has also recommended the revision of City Code Section <br />86.200 to authorize the City Manager to promulgate procedures relating to disconnection of <br />utility services for non-payment. <br /> <br />3. The City Council wishes to adopt an ordinance to implement these <br />recommendations. <br /> <br />I <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. Section 86.200 of the City Code is amended as follows (added text is <br />indicated by underlining; deleted text is indicated by e'fflfStrike): <br /> <br />Sec. 86.200. Delinquencies; penalty; disconnection. <br /> <br />(a) A bill for city utility services, including water, sewer, solid waste collection, <br />drainage and electricity, which are billed in a consolidated manner, is considered <br />delinquent if the full amount of the bill is not paid by the due date. A bill is considered <br />paid when payment is received by the city. <br /> <br />(b) A penalty service charge of ten per cent will be assessed against the portion of all <br />delinquent bills for active accounts that is not paid before the penalty date. For state <br />agencies, an interest charge of one per cent per month will be made to any part of a <br />bill that is not paid within 30 days from the receipt of the bill. An account is <br />considered inactive if it is delinquent for more than 30 days. <br /> <br />I <br /> <br />(c) Any or all city utility services may be terminated for nonpayment of all or any <br />portion of a bill for city utility services if a termination notice is given by the CIty. the <br />bill is not contested under the city's procedures and at least 25 days have elapsed since <br />the date of issuance of the bill. <br />
