He stated he supports <br />this project. Mr. Diaz stated he supports this project, because the money <br />is staying in San Marcos. Mr. Thomaides stated he met with American <br />Housing Foundation, and it is clear they do not have to provide the City <br />any money. He stated he appreciates American Housing Foundation offering <br />to enter into a PILOT and he supports this project. Mayor Narvaiz <br />inquired as to the board. Mr. Sterquell stated the board will need to <br />consist of five members, one member representing the American Housing <br />Foundation, two from the community, one member should be a representative <br />from the University or an educational facility within the community and <br />one member should represent a local or religious organization. Mr. <br />O'Leary stated American Housing Foundation is willing to sign an agreement <br />stating they will not purchase another piece of property in San Marcos. <br />The Council agreed by consensus to bring back a contract and draft <br />language for the Council to appoint an educational foundation board. <br /> <br />I <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption <br />of an Ordinance on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />TEMPORARILY SUSPENDING THE PROCESSING AND ISSUANCE OF "RESTRICTED," <br />OR "RESTAURANT," TABC SPECIFIC USE PERMITS IN THE CENTRAL BUSINESSI <br />AREA ZONING DISTRICTj INCLUDING PROCEDURAL PROVISIONSj PROVIDING FOR <br />PENALTIESj AND DECLARING AN EMERGENCY. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. 1) Ruben Becerra, Chair of the Main Street Advisory Board, <br />requested a temporary suspension of the issuance of SUPS. He stated he <br />supports the letter written by Travis Kelsey, Vice Chair of the Main <br />Street Advisory Board, which the Council has already received. He stated <br />he feels the Ordinance needs some clarification. 2) Larry Rascoe, <br />President of the Downtown Association, stated he offices on the Courthouse <br />Square. He stated the Downtown Association supports this moratorium. He <br />stated the Ordinance allows a business to open up as a restaurant and then <br />after a year shut down the kitchen and turn into a full-time bar. Mayor <br />Narvaiz asked if anyone else wished to speak. No one did, so she closed <br />the public hearing. Mr. Diaz moved for adoption of the Ordinance on <br />emergency, and Mr. Thomaides seconded the motion. Mr. Mihalkanin inquired <br />when the Ordinance would take effect. Mr. Mark Taylor stated the <br />Ordinance would take effect upon publication in the newspaper. Mr. <br />Mihalkanin stated he would like Staff to find out if the TABC has certain <br />rules when it comes to designating a difference between a restaurant, <br />which serves alcohol, and a tavern/bar, which serves food. Mr. Thomaides <br />stated he supports the Downtown Association's request for moratorium. He <br />also stated he feels a one year moratorium is too long.
