<br />9. The Corporation hereby elects to have Section l03(b)(6)(D) of <br />the Internal Revenue Code of 1954, as amended, and the regulations <br />promulgated thereunder, apply to the Bonds, and the President and the <br />Secretary of the Corporation are hereby severally authorized and <br />directed to execute and deliver a statement to the Internal Revenue <br />Service to the effect that the Corporation has so elected~ and to de- <br />liver a copy of such statement to the Purchasers, the User and the <br />Guarantors. <br /> <br />10. Based upon representations made by the User to the Board, the <br />Board hereby affirmatively finds that: <br /> <br />(a) the Project will have the effect of creating and stabi- <br />lizing employment within the Unit; <br /> <br />(b) the Project is required or suitable for the promotion of <br />manufacturing development and expansion and for the industrial <br />development and expansion of industrial facilities and is in <br />furtherance of the public purposes of the Act; and <br /> <br />(c) the Project will contribute to the economic growth or <br />stability of the Unit by: <br /> <br />(i) increasing or stabilizing employment opportunity; <br /> <br />(ii) significantly increasing or stabilizing the property <br />tax base; and <br /> <br />(iii) promoting commerce within the Unit and the State of <br />Texas. <br /> <br />11.
