<br />(1) That meeting the requirements of this chapter would prohibit <br />an owner of pro'perty from usi ng 1 and for a use that the <br />zoning ordinance expressly permits. <br /> <br />(2) That the hardships or difficulties of meeting the <br />requirements of this chapter are peculiar to that property, <br />and not general in character. <br /> <br />(3) That the lack of landscaping will not be detrimental to <br />adjoining property or the health, safety and welfare of the <br />general public. <br /> <br />(4) That the hardships and difficulties of the landscaping and/or <br />buffering are greater that the benefits derived by the <br />general public. <br /> <br />Financial hardship due to meeting the requirements of this <br />chapter is not alone sufficient to grant an exception. <br /> <br />Sec. 14-1/2-8. Enforcement. <br />A. The city manager or an official designated by the city manager <br />shall be the enforcing official. The enforcing official is <br />charged with the duty of administering the provisions of this <br />chapter and securing compliance therewith. In furtherance of <br />this resronsibi1ity, the enforcing official shall: <br /> <br />(1) Make such inspections as may be necessary to effectuate the <br />purposes and intent of this chapterr, and to initiate <br />appropriate action to bring about compliance with this <br />chapter if such inspectins disclose any instance of <br />noncomp1 i ance. <br /> <br />16 <br />
