Womack <br />City Secretary <br /> <br />FROM: <br /> <br />Barbara Jean Edwards <br />City Attorney <br /> <br />SUBJECT: <br /> <br />Legal Objection To Landscaping and Buffering Ordinance <br />Adopted March 15, 1982 <br /> <br />DATE: <br /> <br />June 15, 1982 <br /> <br />RE: <br /> <br />Pursuant to ~3.11 of the Charter of the City of San <br />Marcos I hereby file a legal objection to the 'above named <br />and described ordinance in lieu of approving it as to <br />legality. My reason for failing to approve the ordinance <br />follows: <br /> <br />~14~ (3) (d) (3) states that these credits shall <br />apply where the tree is in a planting area <br />or in an area with impervious cover having <br />a coverage factor of less than 60% according <br />to Appendix B and whose least dimension is one- <br />half (~) the radius of the crown of the tree <br />measured from the tree trunk center. <br /> <br />I believe it to be unclear when looking at Appendix <br />B as to what surfaces will have a coverage factor of less <br />than 60%.
