<br />LEASE <br /> <br />THE STATE OF TEXAS <br /> <br />x <br />X <br />X <br /> <br />THE COUNTY OF HAYS <br /> <br />THIS LEASE made and entered into at San Marcos, Texas, on the <br /> <br /> <br />day of April, 1982, by and between the CITY OF SAN MARCOS, <br /> <br />Hays County, Texas, hereinafter called "Lessor," acting herein by <br /> <br />and through its Mayor, who is duly authorized so to act for and in <br /> <br />behalf of Lessor as the result of an election duly held and con- <br /> <br />ducted within the City of San Marcos on the 3rd day of April, <br /> <br />1982, and the LIONS CLUB OF SAN MARCOS, TEXAS, a non-profit corp- <br /> <br />oration, acting by and through its president, who is duly authorized <br /> <br />so to act for and in behalf of said LIONS CLUB OF SAN MARCOS, <br /> <br />TEXAS, by resolution of its Board of Directors dated April 9 <br /> <br />1982, hereinafter called the "Lessee," <br /> <br />WIT N E SSE T H: <br /> <br />Lessor does hereby lease to Lessee, and Lessee does hereby <br /> <br />lease from Lessor, the outdoor storage/bathroom por~ion of the <br /> <br />recreational building in the San Marcos City Park, together with <br /> <br />access to the parking lot adjacent to that portion of said building, <br /> <br />for the purpose of conducting an inner tube rental operation, said <br /> <br />lease to be on the following terms and conditions: <br /> <br />(1) Lessee shall renovate said portion of the recreational <br /> <br />building into three storage rooms (one of which shall be usable as <br /> <br />a meeting room) and two bathrooms. <br /> <br />(2) Lessee shall have exclusive control and possession of <br /> <br />the leased premises from May 1 to October 31 for a five (5) year <br /> <br />period, namely during the years 1982 through 1986. <br /> <br />(3) At the time of the initial renovation Lessee shall paint <br /> <br />the exterior of said portion of the recreational building and the <br /> <br />two restrooms, and thereafter, shall paint said exterior every <br /> <br />fifth year and the bathrooms every year. <br /> <br />(4) Lessee shall pay all lighting and heating costs attributable <br />
