136 STATE OF TEXAS RENTAL AGREEHENT FOR SPACE IN UNITS A, BAND C AT SAN MARCOS MUNICIPAL AIRPORT COUNTY OF CALD'i\TELL KNOW ALL MEN BY THESE PRESENTS: That this agreement made on , 19 between the City of San Marcos, a municipal corporation, existing-- by and under the laws of the State of Texas, hereinafter, "landlord" and , hereinafter "tenant" witnesseth: That landlord, for and in consideration of the terms and condi- tions, both general and special, hereinafter contained and made on the part of tenant, does hereby grant to tenant for use only by tenant, the privileges hereinafter described on premises at San Marcos Municipal Airport in the County of Caldwell, State of Texas, hereinafter "Airport", to-wit: This agreement shall consist of the following parts: Part I. Part II. Part III. General Conditions Special Conditions Exhibits (If Applicable) all constituting the entire agreement between the parties and no warranties, inducements, considerations, promises or other inter- ferences, shall be implied or impressed upon such agreement. Part I. General Conditions Article I Restrictions of Certain Federal, State and Municipal Statutes and Agreements This agreement shall be subject to: A. Any existing or future federal or state statutes or any existing or future lease or agreement between landlord and the United States or the State of Texas relative to the development, construction, operation, or maintenance of the airport, the execu- tion of which has been or may be required as a condition precedent to the expenditure of federal or state funds for the development, construction, operation or maintenance of said airport. B. Other existing agreements and leases between landlord and the united States and any and all future releases, deeds, leases and agreements hereafter granted or entered into by and between the United States and the City of San Marcos with reference to the con- veyance by the United States to the City of San Marcos of any real or personal property under any existing or future federal statutes authorizing the conveyance of such property by the federal govern- ment to the City for airport purposes. C. The right of landlord to further develop, improve, maintain, modify and repair the landing area, the terminal buildings and other buildings and appurtenances on the airport, as it so sees fit, re- gardless of the desires or view of the tenant and without interfer- ence or hinderance by the tenant. Article II Assignment or Transfer, Subleasing The tenant shall not assign or transfer this agreement, nor any share, part or interest therein, nor any of the rights or priveleges
