<br />35 <br /> <br />RESOLUTION NO. 28R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A LICENSE AGREEMENT BETWEEN SAID <br />CITY AND THE MISSOURI PACIFIC RAILROAD COMPANY <br />CONCERNING A SANITARY SEWER LINE TO BE LAID IN <br />MISSOURI PACIFIC RAILROAD COMPANY RIGHT-OF-WAY <br />IN SAID CITY; AUTHORIZING THE MAYOR OF SAID <br />CITY TO EXECUTE SAID AGREEMENT ON BEHALF OF <br />SAID CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas, has a present <br />need to construct an 8-inch sanitary sewer line beneath right <br />of way owned by Missouri Pacific Railroad Company, said right <br />of way located in said City; and, <br /> <br />WHEREAS, the location of said right of way in which said <br />sanitary sewer line is proposed and intended to be constructed <br />is further described as being at Mile Post 211.6, Engineer's <br />Chainage Station 11283+21, Hays County, Texas, at San Marcos; <br />and, <br /> <br />WHEREAS, for a consideration of $500.00, the Missouri <br />Pacific Railroad Company is willing to grant the request of <br />said City for permission to construct said line on the terms <br />and conditions stated in the attached Pipe Line License; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That the terms and conditions of the Pipe Line <br />License between the City of San Marcos, Texas, and the Missouri <br />Pacific Railroad Company concerning construction of an 8-inch <br />sanitary sewer line in said City, a copy of which Pipe Line <br />License is attached hereto and incorporated herein for all <br />intents and purposes, be, and the same are hereby, approved <br />in all respects. <br /> <br />PART 2. That the Mayor of the City of San Marcos, Texas, <br />be, and she is hereby, authorized to execute said Pipe Line <br />License on behalf of the City of San Marcos. <br /> <br />PART 3.
