<br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE CODE OF <br />ORDINANCES OF SAID CITY TO PROHIBIT THE <br />POSSESSION OF BURNING TOBACCO PRODUCTS AND <br />THE SMOKING OF TOBACCO WITHIN THE CITY OF <br />SAN MARCOS COUNCIL CHAMBERS; PROVIDING FOR <br />NOTICE; PROVIDING FOR FACILITIES FOR EX- <br />TINGUISHMENT OF SMOKING MATERIALS; SETTING <br />A PENALTY AND DECLARING AN EMERGENCY. <br /> <br />50 <br /> <br />ORDINANCE NO. 1982-24 <br /> <br />WHEREAS, recent studies have indicated that secondary smokers <br />(non-smokers who inhale smoke created by others) have a 20-25% <br />greater chance of developing lung diseases than do non-smokers <br />who do not inhale secondary smoke; and, <br /> <br />WHEREAS, the creation of smoke from tobacco products is <br />frequently irritating to others in the vicinity of that smoke; <br />and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />hereby finds and determines that the health and comfort of persons <br />attending City Council meetings and other meetings held in the <br />City of San Marcos Council Chambers located at San Marcos City <br />Hall would be better served and promoted by the prohibition of the <br />possession of burning tobacco products and the smoking of tobacco <br />in said chambers; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Code of Ordinances, City of San Marcos, <br />Texas, is hereby amended by adding a section, to be numbered Sec. <br />2-6, which said section reads as follows: <br /> <br />Sec. 2-6. Smoking tobacco. <br /> <br />(a) No person shall be in possession of a burning <br />tobacco product in the council chambers at <br />San Marcos City Hall at a time when there is <br />prominently displayed in said chambers a <br />reasonably sized notice that smoking is pro- <br />hibited by city ordinance in said chambers <br />and that an offense is punishable by a fine <br />not to exceed $200 and when said chambers are <br />equipped with facilities for extinguishment of <br />smoking materials. <br /> <br />(b) No person shall smoke tobacco in the council <br />chambers at San Marcos City Hall at a time <br />where there is prominently displayed in said <br />chambers a reasonably sized notice that smoking <br />is prohibited by city ordinance in said chambers <br />and that an offense is punishable by a fine not <br />to exceed $200 and when said chambers are equipped <br />with facilities for extinguishment of smoking <br />materials. <br /> <br />(e) Reasonably sized notices shall be placed in the <br />council chambers at San Marcos City Hall, said <br />notices to state that smoking is prohibited by <br />city ordinance and that the offense is punish- <br />able by a fine not to exceed $200. <br /> <br />Cd) The council chambers at San Marcos City Hall <br />shall be equipped with facilities for extinguishment <br />of smoking materials. <br />
