AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CODE OF ORDINANCES OF SAID CITY TO PROHIBIT THE POSSESSION OF BURNING TOBACCO PRODUCTS AND THE SMOKING OF TOBACCO WITHIN THE CITY OF SAN MARCOS COUNCIL CHAMBERS; PROVIDING FOR NOTICE; PROVIDING FOR FACILITIES FOR EX- TINGUISHMENT OF SMOKING MATERIALS; SETTING A PENALTY AND DECLARING AN EMERGENCY. 50 ORDINANCE NO. 1982-24 WHEREAS, recent studies have indicated that secondary smokers (non-smokers who inhale smoke created by others) have a 20-25% greater chance of developing lung diseases than do non-smokers who do not inhale secondary smoke; and, WHEREAS, the creation of smoke from tobacco products is frequently irritating to others in the vicinity of that smoke; and, WHEREAS, the City Council of the City of San Marcos, Texas, hereby finds and determines that the health and comfort of persons attending City Council meetings and other meetings held in the City of San Marcos Council Chambers located at San Marcos City Hall would be better served and promoted by the prohibition of the possession of burning tobacco products and the smoking of tobacco in said chambers; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Code of Ordinances, City of San Marcos, Texas, is hereby amended by adding a section, to be numbered Sec. 2-6, which said section reads as follows: Sec. 2-6. Smoking tobacco. (a) No person shall be in possession of a burning tobacco product in the council chambers at San Marcos City Hall at a time when there is prominently displayed in said chambers a reasonably sized notice that smoking is pro- hibited by city ordinance in said chambers and that an offense is punishable by a fine not to exceed $200 and when said chambers are equipped with facilities for extinguishment of smoking materials. (b) No person shall smoke tobacco in the council chambers at San Marcos City Hall at a time where there is prominently displayed in said chambers a reasonably sized notice that smoking is prohibited by city ordinance in said chambers and that an offense is punishable by a fine not to exceed $200 and when said chambers are equipped with facilities for extinguishment of smoking materials. (e) Reasonably sized notices shall be placed in the council chambers at San Marcos City Hall, said notices to state that smoking is prohibited by city ordinance and that the offense is punish- able by a fine not to exceed $200. Cd) The council chambers at San Marcos City Hall shall be equipped with facilities for extinguishment of smoking materials.
