<br /> <br /> <br /> <br /> <br />ORDINANCE 1982-35 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY 0 <br />OF SAN MARCOS, TEXAS, AMENDING THAT ORDINANCE~ <br />OF OCTOBER 20, 1952, WHICH FIXED RENTALS TO <br />BE PAID BY GAS COMPANIES FOR THE PRIVILEGE <br />OF USING WITH THEIR PIPES AND FIXTURES THE <br />STREETS, EASEMENTS, ALLEYS AND OTHER PUBLIC <br />WAYS WITHIN THE CITY OF SAN MARCOS, TEXAS, <br />TO CHANGE THE FORMULA FOR DETERMINING THE <br />AMOUNT OF SAID RENTALS AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 3 of that Ordinance adopted October <br />20, 1952, by the Board of Commissioners of the City of San Marcos, <br />which fixed rentals to be paid by gas companies for the privilege <br />of using with their pipes and fixtures the streets, easements, <br />alleys and other public ways within the City of San Marcos, Texas, <br />is hereby amended to read as follows: <br /> <br />Section 3. That upon the 1st day of February of <br />each and every year, beginning February 1, 1953, <br />every person, association, organization or corpora- <br />tion occupying or using the streets, highways, ease- <br />ments, alleys, parks or other public places of the <br />City of San Marcos, Texas, with gas pipe lines, gas <br />pipes and other gas fixtures shall, as a condition <br />to such further occupancy, pay to the City annually <br />for such privilege, a rental equal to two per cent <br />(2%) of the gross receipts received by such person, <br />association, drganization or corporation from the <br />sale of gas delivered within the corporate limits <br />of the City of San Marcos, Texas, during the pre- <br />ceeding calendar year ending December 31; provided, <br />however, beginning February 1, 1984 such annual <br />rental payments shall be equal to two percent (2%) <br />of said gross receipts or $160,000, whichever amount <br />is greater. <br /> <br />SECTION 2.
