C 59mA2 THE STATE OF TEXAS LEASE AGREEMENT THE COUNTY OF CALDWELL KNOW ALL MEN BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation under the laws of the State of Texas, acting by authority of a resolution duly adopted on August 9, 1982, by the City Council of said City, here- inafter referred to as "City" and the Confederate Air Force, Inc., hereinafter referred to as "C.A.F." enter into this lease agreement for the mutual benefit of the parties consisting of the following terms and conditions: I. City hereby grants C.A.F. permission to use that real property owned by City and known as the San Marcos Municipal Airport, consisting of concrete aprons, runways, and airspace, for a period of seven (7) days from 12:01 a.m. on the first day of December, 1982, until 12:00 p.m. on the seventh day of December, 1982. II. It is agreed that permission to use the property herein granted to C.A.F. is for the purpose of conducting an air show and related activities. III. As consideration for use of those premises known as the San Marcos Municipal Airport for the described seven (7) day period during the time listed in Part I, C.A.F. agrees to pay to City $1.00 thirty (30) days in advance of the lease period. C.A.F. is not obligated for any additional remuneration to the City, in recognition of the fact that the Confederate Air Force is a non-profit organization and is engaged in staging an event of historical and patriotic significance. IV. It is expressly agreed that C.A.F. will operate any activities con- ducted upon the leased premises pursuant to this lease agreement under those rules and regulations of the Federal Aviation Administration (FAA) governing such activities.
