<br />-6- <br /> <br />shall be unlawful for any person, firm or <br />corporation or their agent to remove such <br />notice without written permission of the <br />Building Inspector, or for any person to <br />enter the building except for the purpose of <br />making the required repairs of or demolishing <br />same. <br /> <br />(g) If the owner of record, occupant, mortgagee, <br />lessee and any person having an interestiin <br />said building as shown by the Deed Records <br />of Hays County, Texas fails to comply with <br />the order provided for in Section 7 1/2-9(f) <br />of this chapter within 10 days, cause such <br />building or structure to be repaired, vacated, <br />or demolished as the facts may warrant under <br />the standards hereinbefore provided for in <br />Section 7 1/2-5 of this chapter, and shall <br />with the assistance of the City Attorney <br />cause the costs of such repair, vacation or <br />demolition to be charged against the land on <br />which the said substandard building or structure <br />existed as a municipal lien, or to be recovered <br />in a suit at law against the owner. A state- <br />ment of any expenses incurred hereby shall be <br />filed with the County Clerk of Hays County. <br />Notice of the statement shall be provided the <br />owner of record by certified mail, return re- <br />ceipt requested to the most recent address <br />appearing on public records. Notice of the <br />statement shall also be posted on the premises. <br /> <br />(h) Report to the City Attorney the names of all <br />persons not complying with the order provided <br />for in Section 7 1/2-8(f) of this Chapter. <br /> <br />Sec. 7 1/2-8. Entry onto premises. <br /> <br />When entering a building, structure or premise that <br />is occupied, the Building Inspector shall first identify <br />himself, present proper credentials and request entry. <br />If entry is refused, the Building Inspector shall have <br />recourse to every remedy provided by law to secure en- <br />try. <br /> <br />Sec. 7 1/2-9. Board of adjustments and appeals. <br /> <br />(a) The duly constituted Building Code Board of <br />Adjustments and Appeals of the City of San <br />Marcos, Texas, shall provide the final <br />interpretation of provisions of this code and <br />shall determine whether a building or structure <br />is substandard and whether it constitutes a <br />hazard to the health, safety and welfare of the <br />citizens of San Marcos. Said five member board <br />shall be composed of one architect, one general <br />contractor or engineer and three members at <br />large from the building industry. <br /> <br />(b) Vacancies. <br /> <br />Vacancies shall be filled for an unexpired term <br />in the manner in which original appointments are <br />required to be made.
