<br /> <br />154 <br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, VACATING AND <br />ABANDONING A PORTION OF DAVID STREET IN <br />SAID CITY, PROVIDING FOR THE REVERSION <br />OF FEE IN SAID LAND AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />ORDINANCE NO. 1982-47 <br /> <br />WHEREAS, the City of San Marcos has received from Joe <br />B. Cox, Delma Cox, Albert R. Reddell, Anne B. Reddell, and <br />other citizens a petition requesting the abandonment by said <br />City of a portion of David Street in said City, said Street <br />shown on the plat of the Cedar Plateau Addition of record in <br />Volume 56, Page 349, Hays County Deed Records, said portion <br />to be vacated and abandoned being the portion located between <br />Prospect Street and Brown Street; and, <br /> <br />WHEREAS, the City of San Marcos has duly determined that <br />Joe B. Cox, Delma Cox, Albert R. Reddell and Anne B. Reddell <br />are the sole owners of all property abutting said portion of <br />David Street; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />has determined that it is in the public interest to abandon <br />said portion of David Street; and, <br /> <br />WHEREAS, said owners of all land abutting said portion of <br />David Street have executed a release, discharging said City from <br />any damages occasioned by said vacation and abandonment; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That a portion of David Street in the City of <br />San Marcos, Hays County, Texas, said portion being that portion <br />located between Prospect Street and Brown Street, said David <br />Street being that street as shown on the plat of the Cedar Plateau <br />Addition to said City of record in Volume 56, Page 349, Hays <br />County Deed Records, be, and is hereby declared to be, and is <br />henceforth vacated and abandoned as to any use, right or claim <br />in, or responsibility for the upkeep or maintenance by the <br />public in general and the City of San Marcos in particular. <br /> <br />SECTION 2. That the fee to said portion of David Street <br />is hereby released and shall revert to Joe B. Cox, Delma Cox, <br />Albert R. Reddell and Anne B. Reddell in proportion to their <br />abutting ownership save and except that easements are reserved <br />for any and all existing utilities. <br /> <br />SECTION 3.
