48 STATE OF TEXAS LEASE COUNTY OF CALDWELL KJ.~OW ALL ~lEN BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation located in Hays County, Texas, existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Emmie Craddock, by Resolution duly adopted on November 8, 1982 ,hereinafter "City", and Walter H. Mengden, hereinafter "Mengden", enter into this lease of a portion of the San Marcos Municipal Airport on the following terms and conditions: I. City is the owner of the San Marcos Municipal Airport by virtue of an indenture from the United States of America dated the 14th day of February, 1966, the 14th day of July, 1969, and the 11th day of May, 1976, to which reference is hereby made and by such reference, made a part thereof. City hereby leases unto Mengden a portion of said Airport for aircraft or aviation purposes. City hereby leases and Mengden hereby rents the premises described on the attached Exhibit A, said premises con- sisting of approximately I '+~O square feet. I City reserves the right to substitute other premises at Airport for said demised premises upon fifteen (15) days written notice to Mengden. Upon receiving such notice, Mengden shall have fifteen (15) days to remove any and all portable structures on said demised premises to the new premises. City shall prepare a description of the new premises which shall become a part of this Agreement for all intents and purposes. Subsequent to the date said description is added to this Agreement, said new premises shall become the "demised" premises for purposes of this Agreement. II. As consideration and rental for the demised premises, Mengden agrees to pay to City the sum of five (5) cents per square foot per month. Pay- ment shall be made in advance. The first payment shall be made on the date
