<br />48 <br /> <br />STATE OF TEXAS <br /> <br />LEASE <br /> <br />COUNTY OF CALDWELL <br /> <br />KJ.~OW ALL ~lEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a municipal corporation located <br /> <br />in Hays County, Texas, existing by and under the laws of the State of <br /> <br />Texas, acting through authority conferred on its Mayor, Emmie Craddock, <br /> <br />by Resolution duly adopted on November 8, 1982 ,hereinafter "City", <br /> <br />and Walter H. Mengden, hereinafter "Mengden", enter into this lease of a <br /> <br />portion of the San Marcos Municipal Airport on the following terms and <br /> <br />conditions: <br /> <br />I. <br /> <br />City is the owner of the San Marcos Municipal Airport by virtue of <br /> <br />an indenture from the United States of America dated the 14th day of <br /> <br />February, 1966, the 14th day of July, 1969, and the 11th day of May, <br /> <br />1976, to which reference is hereby made and by such reference, made a <br /> <br />part thereof. City hereby leases unto Mengden a portion of said Airport <br /> <br />for aircraft or aviation purposes. City hereby leases and Mengden hereby <br /> <br />rents the premises described on the attached Exhibit A, said premises con- <br /> <br />sisting of approximately I '+~O square feet. <br />I <br /> <br />City reserves the right to substitute other premises at Airport for said <br /> <br />demised premises upon fifteen (15) days written notice to Mengden. Upon <br /> <br />receiving such notice, Mengden shall have fifteen (15) days to remove any <br /> <br />and all portable structures on said demised premises to the new premises. <br /> <br />City shall prepare a description of the new premises which shall become a <br /> <br />part of this Agreement for all intents and purposes. Subsequent to the date <br /> <br />said description is added to this Agreement, said new premises shall become <br /> <br />the "demised" premises for purposes of this Agreement. <br /> <br />II. <br /> <br />As consideration and rental for the demised premises, Mengden agrees <br /> <br />to pay to City the sum of five (5) cents per square foot per month. Pay- <br /> <br />ment shall be made in advance. The first payment shall be made on the date <br />
