<br />-3- <br /> <br />VII. <br /> <br />During the term of this lease, City agrees that Hengden shall have <br /> <br />unrestricted access to the runways, taxiways and ramps now in existence at <br /> <br />said Airport to the same extent that any other parties may have use thereof. <br /> <br />It is understood and agreed by and between City and Mengden that the <br /> <br />continuing use of said Airport as an airport for general aviation is essential <br /> <br />to Mengden and that the failure to continue the use of said Airport for air- <br /> <br />port or aviation purposes shall constitute a default in the lease. Upon Mengden <br /> <br />giving written notice of such default to City and upon the failure of City <br /> <br />to cure such default within thirty (30) days after the receipt of said written <br /> <br />notice, this lease shall terminate at the end of the current three month period. <br /> <br />Mengden shall thereupon be released from and relieved of all further obliga- <br /> <br />tions thereafter to accrue hereunder. <br /> <br />VIII. <br /> <br />Maintenance of the runways, taxiways, entrance roads, driveways, existing <br /> <br />parking lots, leading to and/or contiguous to the demised premises and un- <br /> <br />occupied property of said Airport, except for the demised premises described <br /> <br />in Part I of this lease, shall remain the obligation of City; provided, how- <br /> <br />ever, that City shall only be obligated to use airport revenue funds for such <br /> <br />purposes and that City shall never have the obligation to use general, operat- <br /> <br />ting or bond funds for the purpose of said maintenance. <br /> <br />IX. <br /> <br />City agrees that all airport revenue derived from Mengden and any <br /> <br />other user of the property should be allocated toward the maintenance and <br /> <br />improvement of said Airport; provided, however, that this requirement <br /> <br />shall not be construed as mandatory upon City unless so required by exist- <br /> <br />ing indenture or agreement with the United States of America or any amended <br /> <br />or substitute indentures and agreements hereinafter entered into with the <br /> <br />United States of America. <br />
