80 ORDINANCE 1982-60 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING DIVISION 2, EN- TITLED "TEXAS MUNICIPAL RETIREMENT SYSTEM" OF ARTICLE III, ENTITLED "CIVIL SERVICE AND EMPLOYEE BENEFITS" OF CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID CITY BY AUTHORIZING AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, 'UPDATED SERVICE CREDITS' IN SAID SYS- TEM FOR SERVICE PERFORMED BY QUALIFYING MEM- BERS OF SUCH SYSTEM IN THE EMPLOYMENT OF SAID CITY; PROVIDING FOR INCREASED PRIOR AND CURRENT SERVICE ANNUITIES FOR RETIREES AND BENEFI- CIARIES OF DECEASED RETIREES OF SAID CITY; AND DECLARING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MAR- COS, TEXAS: SECTION 1. That Section 2-38 of the Code of Ordinances, City of San Marcos, Texas, is hereby amended to read as follows: Section 2-38. Rate of Employee Contribution and Maximum Earnings Considered. In accordance with the provisions of sub- section (d) of Section 63.401 of Title 1l0B, Revised Civil Statutes of Texas, 1925,as amended, the de- posits required to be made to the Texas Munici- pal Retirement System by employees of the several administrative units on account of current ser- vice shall be calculated from and after the date aforesaid on the full amount of such person's earnings as an employee of the City. SECTION 2. That Section 2-43 of the Code of Ordinances, City of San Marcos, Texas, is hereby amended to read as follows: Section 2-43. Authorization of Updated Service Credits. On the terms and conditions set out in Sec- tions 63.401 through 63.403 of Title 110B, Re- vised Civil Statutes of Texas, 1925, as amended, each member of the Texas Municipal Retirement System who has current service credit or prior service credit in said System in force and effect on the 1st day of January, 1983, by reason of service in the employment of the City of San Marcos, and on such date has at least 36 months of credited service with said system, shall be and is hereby allowed "Updated Service Credit" (as that term is defined in subsection (d) of Section 63.402 of said title) in an amount that is 100% of the "base Updated Service Credit" of the member (calculated as provided in subsection (c) of Section 63.402 of said title). The Up- dated Service Credit hereby allowed shall replace any Updated Service Credit, prior service credit, special prior service credit, or antecedent ser- vice credit previously authorized for part of the same serVlce.
