<br />83 <br /> <br />RESOLUTION 1982-63R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING THE <br />TERMS AND CONDITIONS OF AN AGREEMENT FOR <br />MUTUAL AID IN FIRE PROTECTION BETWEEN <br />SAID CITY AND THE CITY OF SEGUIN, TEXAS, <br />AUTHORIZING THE MAYOR OF SAN MARCOS TO <br />EXECUTE SAID AGREEMENT AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, The State of Texas pursuant to Article 6228f, <br />Texas Revised Civil Statutes has declared it to be the public <br />policy of the State to provide financial assistance to the <br />surviving spouse and minor children of paid firemen when such <br />paid firemen suffer violent death in the course of the perfor- <br />mance of their duties; and, <br /> <br />WHEREAS, the federal government, pursuant to 42 U.S.C.S. <br />~3793, provides for the payment of certain benefits to the <br />surviving spouse and/or children of public safety officers <br />who have died as a "proximate result of a personal injury sus- <br />tained in the line of duty"; and, <br /> <br />WHEREAS, insurance contracts entered into by some fire- <br />men and various pension systems provide for the payment of death, <br />disability and/or injury benefits when death or injury occurs <br />in the line of duty; and, <br /> <br />WHEREAS, it is to the benefit of the firemen of the City <br />of San Marcos to have clearly established that responding to <br />or working at a fire or other emergency outside said City's <br />jurisdictional area but within an area with which the City <br />of San Marcos has entered into an Agreement For Mutual Aid In <br />Fire Protection is work "in the line of duty" for City of <br />San Marcos firemen; and, <br /> <br />WHEREAS, the City of San Marcos has the authority, pursuant <br />to the Texas Interlocal Cooperation Act, Article 4413(32c), Texas <br />Revised Civil Statutes, to enter into agreements with other <br />cities for the provision of fire protection services; now, there- <br />fore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That the Agreement For Mutual Aid In Fire Protection <br />between the City of San Marcos, Texas, and the City of Seguin, <br />Texas, a copy of which is attached hereto and incorporated herein <br />for all intents and purposes, be, and the same is hereby, approved <br />in all respects. <br /> <br />PART 2. That the Mayor of the City of San Marcos, Texas, <br />Emmie Craddock, be, and she is hereby, authorized to execute said <br />Agreement on behalf of the City of San Marcos, Texas. <br /> <br />PART 3.
