<br />AUTOMATED CLEARING HOUSE (ACH) CUSTOMER-INITIATED PAYMENTS <br /> <br />Our ACH Customer-Initiated Payments service allows your consumer or business <br />customers to pay you for goods or services by using your website. Your customers can <br />authorize payments to you through commands on your website or by touch-tone or voice <br />commands on the telephone. Detailed information regarding this Service is available in <br />the applicable User Documentation. <br /> <br />Payments will be made by creation of an ACH Entry to credit your account with us and will <br />be subject to the provisions of our Automated Clearing House Services. You act as the <br />Originator, your customer acts as the Receiver and we act as the ODFI with respect to the <br />Entries. You warrant that you have obtained appropriate authorization from each Receiver <br />and that Entries conform to such authorization and comply with the NACHA Rules. You <br />also make to us the same warranties as we make with respect to Entries under the <br />NACHA Rules. <br /> <br />CASHPAY@ <br /> <br />Our CashPay@ Service allows you to pay your employees and other payees by directly <br />depositing payments to their Cash Pay accounts. Your payees can immediately access <br />their money through ATMs and point of sale (POS) terminals. <br /> <br />CASHPAY FUNDING OPTIONS <br />You may fund the Cash Pay accounts in one of two ways: by initiating Entries through the <br />Automated Clearing House (ACH) system or, upon our approval. by instructing us to <br />transfer funds from a deposit account you maintain with us. (ACH Services are governed <br />by the ACH section of this Booklet.) <br /> <br />If you choose to pay by the transfer of funds from your account with us, we will debit your <br />account following receipt of your payment instructions in a mutually agreed-upon format <br />and method. You must have sufficient Collected and Available Funds in your account to <br />cover the transfer amount. In the event that sufficient funds are not available at the time <br />of settlement, you agree that we may take steps to protect ourselves, including refusing <br />to fund Cash Pay accounts and terminating the Cash Pay Service (which will not affect <br />funds previously transferred to Cash Pay accounts), without incurring any liability to you <br />or your payees. <br /> <br />CERTIFICATION OF ENROllMENT INFORMATION <br />You must provide us information for each payee who wishes to open a Cash Pay account. <br />Each time you provide us with such information or initiate a transfer offunds to a <br />Cash Pay account, you certify that the following statements are true and accurate as of <br />such date: <br /> <br />. The payee is entitled to receive payments issued by you, and is otherwise qualified to <br />participate in the Cash Pay program. <br /> <br />.
