<br />-I <br /> <br />so, if the tax payment and our related service fees and charges exceed the Collected and <br />Available Funds on deposit in your account or your ACH processing limit. If we reject a <br />Tax Payment Instruction for that reason, we will promptly notify you by telephone or <br />facsimile transmission in which case we will not be liable to you for the tax payment, any <br />interest on the amount of your tax liability, or for any tax penalty imposed on you in <br />connection with the tax liability. You agree these means of communication are a <br />reasonable means of notifying you. <br /> <br />CANCELLATION <br />Subject to the provisions in the User Documentation, you may cancel a Tax Payment <br />Instruction prior to disconnection of the telephone call in the case of an instruction <br />initiated by touchtone telephone or prior to transmission to us of an instruction initiated <br />through your computer. <br /> <br />Thereafter, a Tax Payment Instruction may be canceled only if: <br /> <br />. The tax payment has not been remitted, credited or otherwise made available to a tax <br />authority; <br /> <br />. A request to cancel provides sufficient information for us to effect the request; and <br /> <br />-- <br /> <br />. The request is received by us by telephone or, at the option of either you or us, in <br />writing (including facsimile transmissions) in time (but in no event later than the <br />deadline specified in the applicable User Documentation) to afford us a reasonable <br />opportunity to effect the request. <br /> <br />OVERPAYMENTS <br />If we make an overpayment of your tax liability due to our error, we will recredit your <br />account for the amount of the overpayment, and you agree to take such actions as we <br />reasonably request to obtain a refund of the overpayment and to arrange for payment of <br />such refund to us. In any event, you agree to repay us for any overpayment upon the <br />earlier of (i) your recovery of such overpayment or (ii) the application of the related tax <br />credit to another of your tax payment obligations. <br /> <br />RECORDS AND NOTICE OF ERRORS <br />We will provide you with statements and confirmations containing information about <br />your tax payments in accordance with and subject to the applicable User Documentation. <br /> <br />Nothing in this Booklet relieves you of any duty imposed by law or contract regarding the <br />maintaining of records or from employing adequate audit, account and review practices <br />customarily followed by similar businesses. You will promptly review for accuracy all <br />records, information and statements delivered from time to time to you by us. <br /> <br />You must send us written notice. with a statement of relevant facts. within 14 days after <br />you receive the first notice or statement indicating a discrepancy between our records <br />and yours. If you fail to give the required notice, we will not be liable for any loss of <br />interest or for any compensation for any other loss or cost relating to an unauthorized or <br />erroneous debit to your account or because of any other discrepancy in the notice or <br />account statement.
