<br />-I <br /> <br />We reformat and transmit your payment order to another bank, and we have no duty to <br />do so if your request is defective, incomplete, erroneous or inconsistent with the terms of <br />this Booklet. We may act on your Multibank instructions as we reasonably consider <br />appropriate notwithstanding any error, omission, defect or lack of clarity in its terms and <br />even if the instructions appear to duplicate other Multibank requests. You agree that <br />your indemnity of us, as set forth in the "Protection From Third Parties" section of this <br />Booklet, applies to any claims by another bank based on our sending a Multibank <br />instruction containing any error, omission, defect or lack of clarity. <br /> <br />If you wish to cancel or amend a payment order set forth in a Multibank instruction, you <br />must contact the bank to which the payment order is directed and act in accordance with <br />its procedures. <br /> <br />Reports on Multibank instructions which we have processed will be included in an <br />Information Reporting Service which you have arranged to use. <br /> <br />COMPLIANCE WITH RULES AND LAWS <br />You agree to comply with all applicable payment system rules, including the national <br />payment system rules and any other applicable laws and regulations of the receiving <br />country of your transaction. You also agree to comply with the authorization and notice <br />requirements applicable to any Request to debit another person's account. <br /> <br />-I <br /> <br />AUTHORIZED PERSONS <br />Before using a Wire Transfer or International Electronic Funds Transfer Service, you give <br />us a written list, in a form acceptable to us, of the persons a uthorized by you to perform <br />certain duties in connection with such Service. <br /> <br />SECURITY PROCEDURE <br />You agree to use a Service in accordance with the relevant Security Procedure, if any. The <br />purpose of the Security Procedure is to verify the authenticity of Requests delivered to us <br />in your name and not to detect errors in the transmission or content of Requests. You <br />represent and warrant each time you use a Wire Transfer or International Electronic <br />Funds Transfer Service that, in view of your requirements, the Security Procedure is a <br />satisfactory method of verifying the authenticity of Requests. <br /> <br />You agree that we may act on Requests, even if they are unauthorized, if we act in good <br />faith and comply with the applicable Security Procedure and any written agreement with <br />you restricting our action on Requests. In such cases, we may enforce or retain your <br />payment to us for such Requests; provided, however, we may not enforce or retain <br />payment if you prove that the unauthorized Requests were not caused by a person (i) <br />entrusted at any time to act for you with respect to Requests or the applicable Security <br />Procedure, (ii) who obtained access to your premises, computer equipment or transmitting <br />facilities or (iii) who obtained, from a source controlled by you, information (such as keys <br />and passwords) which facilitated breach of the applicable Security Procedure. <br /> <br />ACCOUNT DEBITS <br />You must have Collected and Available Funds in your account which, when added to <br />funds which may be made available under a line of credit, are sufficient to cover your <br /> <br />-~ <br />
