<br />2.7 If the Transaction is approved by the Authorization system, you will require <br />Consumer to confirm his or her authorization of the Conversion Service by <br />signing the Transaction Receipt provided by the Bank System. At a <br />minimum, the Transaction Receipt will include all of the information required <br />by NACHA and Visa Rules. <br /> <br />2.8 You will provide each Consumer who completes a Transaction through <br />Electronic Check Services with: (a) the Consumer's Check, which Merchant <br />has voided; (b) a copy of the Consumer's signed Transaction Receipt; and <br />(c) a receipt containing specific information as to the purchase or sale of <br />goods or services for which payment was made, as required by law. Any <br />required receipt referenced in 2.8(c) is your sole responsibility. If you rely on <br />the Terminal Receipt in order to comply with this requirement, you represent <br />and warrant to us that the Terminal Receipt meets all requirements <br />applicable to your business. You will void the Check by writing the word <br />"Void Converted to Electronic Payment" in large letters across the face of <br />the Check. <br /> <br />3. Other Electronic Check Service Requirements <br /> <br />3.1 You will retain a copy of each Transaction Receipt for a minimum of two (2) <br />years, or such longer period as may be required by law, NACHA or Visa <br />Rules, in a complete and readable manner, by which an individual <br />Transaction Receipt may be retrieved to respond to an inquiry by the <br />Consumer. <br /> <br />3.2 You may not add any fee or charge to Consumers for use of Electronic <br />Check Service. <br /> <br />3.3 For each Transaction for which you receive Authorization, Bank System will <br />automatically generate an electronic debit entry to the Consumer's Account, <br />in accordance with the information input to the pas Terminal. You <br />understand and agree that pas Transactions are considered ACH <br />transactions, and that Checks successfully processed are not subject to the <br />Uniform Commercial Code rules regarding checks. <br /> <br />3.4 You must make the Electronic Check Service available at each checkout lane <br />at which paper checks are accepted, unless specifically authorized in writing <br />by us. <br /> <br />3.5 You warrant that each pas Transaction is a bona fide sale of goods or <br />services or both by you, represents a valid obligation for the amount shown <br />on the Transaction Record, was made with the full and proper authorization <br />of the Consumer and is for a consumer purpose. You further warrant that the <br />pas Transaction is not known to be fraudulent or uncollectible. You further <br />warrant that the POS Transaction represents a sale of goods and services by <br />you to Consumer and does not involve any transaction with a third party. For <br />the purposes of this Section 3.5, "transaction with a third party" includes <br />transactions between a franchisee, partner, independent contractor or joint <br />venturer of yours and consumer. <br /> <br />I <br /> <br />I <br /> <br />6 <br /> <br />I <br />
