89. <br /> <br /> PROFESSIONAL SERVICES AGREEMENT FOR <br /> THE COORDINATION OF THE <br />CENTRAL TEXAS HOUSEHOLD HAZARDOUS WASTE MOBILE PROGRAM <br /> <br /> This AGREEMENT is made this the 25th day of February, 2003, between the City <br />of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Geo-Visions <br />(the "Consultant"), 1401 Woodlawn Blvd., Austin, Texas 78703, for the provision of <br />professional services for the coordination of the Central Texas Household Hazardous Waste <br />Mobile Program for the City of San Marcos. <br /> <br />The City and the Consultant agree as follows: <br /> <br /> ARTICLE 1 <br />CONSULTANT'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1.1.1 Consultant will be responsible for the professional coordination services for the Central <br />Texas Household Hazardous Waste Mobile Program for the City of San Mamos (the "Project"). <br />The purpose of this Project is to provide affordable household hazardous waste collection <br />through a regional household hazardous waste management program which includes an <br />educational campaign in addition to up to four one-day collection events. This Project is under <br />the sponsorship of the City and will include affordable household hazardous waste collection for <br />the City of San Marcos, Hays County, the Barton Springs Edwards Aquifer Conservation <br />District, the City of Locldaart, the City of Lakeway, the City of Giddings, the City of Buda, Lee <br />County, Hurst Creek MUD and the Travis County Water Control and Improvement District No. <br />17 (the "Participating Communities"). This Project is being financed in part with funds from the <br />Texas Commission on Environmental Quality ("TCEQ") through a grant from the Capital Area <br />Planning Council ("CAPCO"). The Consultant certifies that it is fully familiar with federal, state <br />and local regulations regarding household hazardous waste collection and other waste streams. <br />Consultant is experienced and familiar with all reporting requirements of both CAPCO and the <br />TCEQ. Consultant will perform ail of its services so that the Project will proceed in accordance <br />with the guidelines promulgated by the TCEQ and CAPCO. <br /> <br />1.1.2 The Consultant's services are described in Sections 1.1 through 1.9. <br /> <br />1.1.3 The performance of all services by the Consultant in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines. In performing all services under this Agreement, the <br />Consultant will use that degree of care and skill ordinarily exercised for similar projects by <br />professionals who possess special expertise in the types of services involved under this <br />Agreement. No work under this Agreement will be subcontracted by tbe Consultant without prior <br />written approval from the City. Any work or services subcontracted under this Agreement shall <br />be specified by separate written Agreement and shall be subject to each provision of this <br />Agreement.
