89. PROFESSIONAL SERVICES AGREEMENT FOR THE COORDINATION OF THE CENTRAL TEXAS HOUSEHOLD HAZARDOUS WASTE MOBILE PROGRAM This AGREEMENT is made this the 25th day of February, 2003, between the City of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Geo-Visions (the "Consultant"), 1401 Woodlawn Blvd., Austin, Texas 78703, for the provision of professional services for the coordination of the Central Texas Household Hazardous Waste Mobile Program for the City of San Marcos. The City and the Consultant agree as follows: ARTICLE 1 CONSULTANT'S SERVICES AND RESPONSIBILITIES 1.1 STANDARDS OF PERFORMANCE 1.1.1 Consultant will be responsible for the professional coordination services for the Central Texas Household Hazardous Waste Mobile Program for the City of San Mamos (the "Project"). The purpose of this Project is to provide affordable household hazardous waste collection through a regional household hazardous waste management program which includes an educational campaign in addition to up to four one-day collection events. This Project is under the sponsorship of the City and will include affordable household hazardous waste collection for the City of San Marcos, Hays County, the Barton Springs Edwards Aquifer Conservation District, the City of Locldaart, the City of Lakeway, the City of Giddings, the City of Buda, Lee County, Hurst Creek MUD and the Travis County Water Control and Improvement District No. 17 (the "Participating Communities"). This Project is being financed in part with funds from the Texas Commission on Environmental Quality ("TCEQ") through a grant from the Capital Area Planning Council ("CAPCO"). The Consultant certifies that it is fully familiar with federal, state and local regulations regarding household hazardous waste collection and other waste streams. Consultant is experienced and familiar with all reporting requirements of both CAPCO and the TCEQ. Consultant will perform ail of its services so that the Project will proceed in accordance with the guidelines promulgated by the TCEQ and CAPCO. 1.1.2 The Consultant's services are described in Sections 1.1 through 1.9. 1.1.3 The performance of all services by the Consultant in connection with this Agreement will be by persons appropriately licensed or registered under State, local and Federal laws governing their respective consulting disciplines. In performing all services under this Agreement, the Consultant will use that degree of care and skill ordinarily exercised for similar projects by professionals who possess special expertise in the types of services involved under this Agreement. No work under this Agreement will be subcontracted by tbe Consultant without prior written approval from the City. Any work or services subcontracted under this Agreement shall be specified by separate written Agreement and shall be subject to each provision of this Agreement.
