RESOLUTION 2006 - 5 5 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LEASE AGREEMENT BElWEEN THE CITY AND THE CAPITAL AREA COUNCIL OF GOVERNMENTS FOR A SITE TO PLACE AIR QULAITY MONITORING EQUIPMENT; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE THE AGREEMENTS, AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The Capital Area Council of Governments (CAPCOG) is a regional planning commission and political subdivision of the state created and operating under the Texas Regional Planning Act of 1965, as amended, chapter 391 of the Local Government Code. 2. CAPCOG has received a grant from the Texas Commission on Environmental Quality to monitor air quality in the Central Texas region. CAPCOG has contracted with Air Quality Solutions, Inc., of Austin, Texas, to operate the air quality monitoring equipment. 3. The City has an area within the site of the City's water tower located at the corner of Comanche and Sessom suitable for locating the air quality monitoring equipment, and CAPCOG desires to lease the site for this purpose. 4. The City Council of the City of San Marcos, Texas, desires to enter into agreement with CAPCOG to lease space at the site of the City's water tower located at the corner of Comanche and Sessom to place air quality monitory equipment. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The terms and conditions of the attached lease agreement between the City and CAPCOG are approved. PART 2. The City Manager, Dan O'Leary is authorized to execute this agreement on behalf of the City. PART 3. That this Resolution shall be in full force and effect from and after its passage.
