<br />approval of the Petitioner's petition. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The Petitioner's petition for extension of the City's water and wastewater system mains to <br />serve the Property is approved, subject to the following conditions: <br /> <br />A. If the Property is not contiguous to the existing city limits at the time the City initiates the <br />annexation of the Property, the Petitioner must submit a written request for annexation of a strip of <br />property at least 15 feet in width from each property owner (including, for public rights-of-way, requests <br />from the entities having jurisdiction over the rights-of-way) along the intended route of the utility lines. <br /> <br />B. The extensions and all associated equipment, facilities and appurtenances must be constructed <br />at the sole expense of the Petitioner (subject to the City's policies on oversizing). <br /> <br />C. The extensions and all associated equipment, facilities and appurtenances must be constructed <br />in accordance with the City's Technical Construction Standards and Specifications, the provisions of <br />Chapter 86 of the City Code, and all other applicable City regulations and standards. <br /> <br />D. The Petitioner must demonstrate, through engineering information submitted to and approved <br />by the Director of the Water and Wastewater Department, that adequate water supply and water and <br />wastewater line capacity is available in connection with any development or subdivision plat proposed for <br />the Property. Significant City utility improvement projects may need to be completed before this supply <br />and capacity will be available. <br /> <br />E. The Petitioner must fully comply with all applicable land development regulations, including <br />without limitation, the City's Land Development Code. <br /> <br />PART 2. The Petitioner's petition for annexation of the Property is approved, and the City staff is <br />directed to proceed to prepare a proposed service plan for the annexation of the Property. <br /> <br />PART 3. This Resolution shall be in full force and effect from and after its passage. The approval in <br />Part 1 of this Resolution shall take effect upon the City Manager's determination that the Petitioner has <br />complied with all of the conditions listed in Part 1 above. <br /> <br />ADOPTED on <br /> <br />April 4, 2006 <br /> <br />~~~o <br /> <br />Mayor <br /> <br />Attest: c/t <br />(1 . vi..
