ORDINANCE NO. 2011 -78 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 2, ARTICLE 3, DIVISION <br />14 OF THE SAN MARCOS CITY CODE BY REDUCING THE SIZE <br />OF THE SAN MARCOS AIRPORT COMMISSION FROM NINE <br />MEMBERS TO FIVE MEMBERS AND REDUCING THE PERMITTED <br />NUMBER OF NONRESIDENTS ON THE COMMISSION FROM <br />THREE TO TWO; AND INCLUDING PROCEDURAL PROVISIONS <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 2, Section 2.332 of the San Marcos City Code is amended as follows <br />(underlining indicates added text, strike' rough indicates deleted text): <br />Sec. 2.332. Composition; qualifications and appointment of members. <br />The airport commission consists of nine five members. Three members of the <br />commission must be residents of the city. Three Two members may be either residents or <br />nonresidents of the city. All other members of the commission will be appointed by the <br />city council in January of each year. Members shall serve staggered terms of two years, <br />except that vacancies or newly created positions will be filled for the unexpired term to <br />be filled. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 4. This Ordinance will take effect immediately following its adoption on second <br />reading. <br />PASSED on first reading on December 14, 2011. <br />PASSED, APPROVED AND ADOPTED on January 3, 2012. <br />Daniel Guerrero <br />Mayor <br />
