<br />use and removal of its equipment, and shall be responsible and liable at all times for all <br />losses to and damages to Lessee's equipment upon the Leased Premises and any and all other <br />property of Lessee located upon the Leased Premises. <br />d. Lessee's equipment shall be installed upon the Leased Premises in accordance with the plans <br />and drawings which are attached as Exhibit B. Lessor may periodically inspect the <br />equipment for conformance with the plans and drawings and other provisions of this <br />Agreement. <br />3. Access to Leased Premises: <br />a. Lessee shall have the unrestricted right to enter or leave the premises where the equipment <br />is located. Lessee agrees to take, at its expense, all measures and precautions necessary to <br />render its equipment and Lessor's premises inaccessible to unauthorized persons. Lessor <br />agrees that it will not give unauthorized persons access to Lessee's equipment. <br />b. Lessor shall provide Lessee with road access to the Leased Premises throughout the term of <br />this Agreement. <br />c. Lessor shall at all times have access to the Leased Premises. <br />4. Governmental Approvals: <br />Lessee shall be solely responsible for receiving approval from all governmental and regulatory <br />authorities for the installation, use, maintenance, and removal of its equipment upon the Leased <br />Premises. If Lessee is unable to secure all appropriate approvals, this Agreement may be canceled <br />by Lessee by providing 30 days written notice to L~ssor and all advance rentals paid by Lessee to <br />Lessor shall be refunded. <br />5. Term: <br />The initial term ofthis Agreement begins (the "commencement date") on the later of 1) the date the <br />Lessor's Planning and Zoning Commission approves a specific use permit for Lessee's attachment <br />rights, or February 1, 1999, and the initial term ends on the fifth anniversary of the commencement <br />date. After the initial term of this Agreement, this Agreement will automatically be renewed for <br />one-year periods on each successive anniversary of this ending date of the initial term unless one <br />party notifies the other at least 30 days in advance of an anniversary date of its intention not to renew <br />the Agreement. If such a notice is given, this Agreement is terminated on the anniversary date that <br /> <br />2 <br />
