<br />interest, court costs, legal fees and all other expenses occurring in connection with Lessee's use of <br />the Leased Premises under this Agreement. Lessee agrees to investigate, respond to, and defend any <br />such claims, demands, or suits at the sole expense of Lessee. The indemnity required by this <br />Agreement shall not be limited by reason of the specification of any particular insurance coverage <br />in this Agreement. Lessee further agrees to obtain from its contractors, subcontractors, and <br />consultants the same indemnification in writing of Lessor as stated above. <br />15. Insurance: <br />a. The Lessee shall, at its own expense, purchase and maintain insurance to protect itself and <br />Lessor from claims which may arise out of its operations under this Agreement, whether the <br />operations are by itself or by any subcontractor or by anyone directly or indirectly employed <br />by any of them or by anyone for whose acts any of them may be liable. The amounts of <br />insurance coverage shall be at least the following: <br />(1) Workers' compensation insurance - statutory limits. <br />(2) Comprehensive general liability insurance - $500,000/$1,000,000/ $500,000 or <br />$1,000,000 combined single limit. <br />b. The insurance coverage carried by Lessee shall be written so that the Lessor will notified in <br />writing, in the event of cancellation, restrictive amendment or non-renewal at least 30 days <br />prior to the action. The coverage shall also include a waiver of all of Lessee's rights of <br />subrogation against Lessor, except as to the workers' compensation coverage. Certificates <br />of Insurance shall be filed with the Lessor OJ;l an annual basis prior to the expiration of the <br />current insurance policy and are subject to Lessor's prior approval. <br />c. The generalliabilitv insurance coverage required by this agreement shall be written <br />with the Citv of San Marcos. Texas. as additional insured. The stated limits of insurance <br />required are minimum only, and it shall be Lessee's responsibility to determine what limits <br />are adequate. These minimum limits may be basic policy limits or any combination of basic <br />limits and umbrella limits. In any event, the Lessee is fully responsible for all losses arising <br />out of, resulting from or connected with operations under this Agreement whether or not the <br />losses are covered by insurance. <br /> <br />5 <br />
