<br /> <br />99. <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />AMENDMENT NO.1 <br />PROFESSIONAL SERVICES AGREEMENT <br />FOR COORDINATION OF THE <br />CENTRAL TEXAS HOUSEHOLD HAZARDOUS WASTE MOBILE PROGRAM <br /> <br />The City of San Marcos ("City") and Denise Vergez ("Consultant") agree to amend the <br />Professional Services Agreement (the "Agreement") dated June 23, 1998 as follows: <br /> <br />1. Section 10.1 of Article 10 of the Agreement is amended to read as follows: <br /> <br />10.1 This Agreement represents the entire and integrated Agreement between the City <br />and the Consultant and supersedes all prior negotiations, representations or agreements <br />either written or oral. This Agreement may be amended only by written instrument <br />approved by the City's governing body and signed by both the City and Consultant. <br /> <br />2. Section 11.2 of Article 11 of the Agreement is amended to add reimbursable <br />expenses in the amount of $5,249.57 as part of Consultant's compensation and to <br />increase the total fee to be paid to the Consultant from $45,878.50 to $51,128.07. <br /> <br />3. The parties agree that all of the remaining terms and conditions of the original <br />Agreement shall remain in effect and continue to govern for the duration of the Agreement. <br /> <br />By the signing of this amendment, the parties expressly understand and agree that this <br />amendment will become a part of the Agreement identified above. <br /> <br />City of San Marrj <br />+-c:~ "-'{ <br /> <br />Larry D.
