<br />That the City of San Marcos, Texas, a Texas municipal corporation, 630 East Hopkins Street.
<br />San Marcos, Hays County, Texas 78666, hereinafter called "Grantor," for and in consideration
<br />of the sum of Ten and No/lOO Dollars ($10.00), together with other good and valuable
<br />consideration, to Grantor cash in hand paid by CalTex Holdings, Inc., a Texas corporation.
<br />3312 Barker Hollow Pass. Austin, Travis County, Texas 78749, hereinafter called "Grantee".
<br />the receipt of which is hereby acknowledged, has GRANTED, SOLD and CONVEYED, and
<br />by these presents does GRANT, SELL and CONVEY unto the said Grantee all that certain lot.

<br />limitations, easements and reservations, if any, apparent on the ground, and easements, if any.
<br />in use by the City or any other public utility, or now in force and existing of record in the office
<br />of the County Clerk of Hays County, Texas, to which reference is here made for all purposes.
<br />Notwithstanding any other term, condition or provision hereof, the above described premises are
<br />conveyed by Grantor, and Grantee takes and accepts the premises, "AS IS, WHERE IS".

<br />TO HAVE AND TO HOLD the above described premises, together with all and singular
<br />the rights and appurtenances thereto in anywise belonging, unto the said Grantee. CalTex
<br />Holdings, Inc., its successors and assigns forever, and Grantor does hereby bind itself. and its
<br />successors and assigns, to .WARRANT AND FOREVER DEFEND. all and singular. the said
<br />premises unto the said Grantee, its successors and assigns, against every person whomsoever
