OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, WATERWORKS AND WASTE WATER SYSTEM REVENUE BONDS, SERIES 1999, IN THE AGGREGATE PRINCIPAL AMOUNT OF $6,300,000; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY WHEREAS, this City Council (the "City Council"), by resolution adopted on January 11, 1999, as the result of circumstances described in such resolution, ratified a first publication and directed a second publication of notice of the intention of the City of San Marcos, Texas (the "City") to issue not to exceed $6,300,000 waterworks and sewer system revenue bonds of the City for the purposes set forth in such notice; WHEREAS, such notice was published in the manner and to the extent required by law; WHEREAS, there has not been filed with the City Secretary or any other office of the City a petition protesting the issuance of such revenue bonds and requesting an election on same; and WHEREAS, it is affirmatively found and determined that the City is authorized to proceed with the issuance and sale of such revenue bonds as authorized by the laws of the State of Texas, including, particularly, Tex. Rev. Civ. Stat. Ann. arts. 2368a and 1111, et seq.; Now, Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: ARTICLE I DEFINITIONS AND OTHER PRELIMINARY MA TIERS Section 1.01. Definitions. Unless otherwise expressly provided or unless the context clearly requires otherwise, in this Ordinance the following terms shall have the meanings specified below: "Additional Parity Obligations" means those obligations the City reserves the right to issue on a parity with the Bonds, herein authorized in accordance with the terms and conditions prescribed in Section 9.01 hereof. "Bond" means any of the Bonds. "Bonds" means the City's bonds entitled "City of San Marcos, Texas, Waterworks and Waste Water System Revenue Bonds, Series 1999" authorized to be issued by Section 3.01 of this Ordinance. "Closing Date" means the date of the initial delivery of and payment for the Bonds.
