<br />tr <br />, :& IS"" <br />c.rl:J ~ <br />t..'J _ <br />11.1 0 <br />!IN "a i'l"\ <br />uli"b 0 <br />- CO <br />11m;; W-I. <br />~ 1..1... <br />\ ,Ii <br /> <br />~~ <br />j:!:C($ <br />LJ.J:;E <br />O::c <br />fr3~ <br />CIJ_ <br />~Q <br />_b <br />yy <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUmORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, <br />TEXAS, COMBINATION TAX AND REVENUE CERTIFICATES OF <br />OBLIGATION, SERIES 1999, IN THE AGGREGATE PRINCIPAL AMOUNT OF <br />$2,500,000; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID <br />CERTIFICATES; PRESCRIBING THE FORM OF SAID CERTIFICATES; <br />AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; <br />ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND <br />DECLARING AN EMERGENCY <br /> <br />WHEREAS, the City Council (the "City Council") of the City of San Marcos, Texas (the "City"), <br />by resolution adopted on January 11, 1999, directed publication of notice of the City's intention to issue a <br />maximum principal mount not to exceed $2,500,000 of certificates of obligation of the City for the purposes <br />hereinafter set forth; <br /> <br />WHEREAS, such notice was published in the manner and to the extent required by law; <br /> <br />WHEREAS, there has not been filed with the City Secretary or any other officer of the City a petition <br />protesting the issuance of such certificates of obligation and requesting an election on same; and <br /> <br />WHEREAS, it is affirmatively found and determined that the City is authorized to proceed with the <br />issuance and sale of such certificates of obligation as authorized by the Constitution and laws of the State <br />of Texas, including, particularly, Tex. Loc. Gov't Code Ann. ch. 271, subch. C, and Tex. Rev. Civ. Stat. Ann. <br />arts. 1111, et seq., as amended; Now, Therefore <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF SAN MARCOS: <br /> <br />ARTICLE I <br /> <br />DEFINITIONS AND OTHER PRELIMINARY MATTERS <br /> <br />Section 1. 01. Definitions. <br /> <br />Unless otherwise expressly provided or unless the context clearly requires otherwise, in this <br />Ordinance the following terms shall have the meanings specified below: <br /> <br />"Certificate" means any of the Certificates. <br /> <br />"Certificates" means the City's certificates of obligation entitled "City of San Marcos, Texas, <br />Combination Tax and Revenue Certificates of Obligation, Series 1999" authorized to be issued by Section <br />3.01 of this Ordinance. <br /> <br />"Closing Date" means the date of the initial delivery of and payment for the Certificates. <br /> <br />R\SANMAR\CO 99\DOCS\ORDNCED 1.
