12.3 In the even of any conflict between the Agreement and the provisions of any exhibit or attachment to this Agreement, this Agreement will govern and control. ARTICLE 13 OTHER DUTIES AS SET FORTH IN THE CONSTRUCTION DOCUMENTS 13.1 Architect will have such other duties and responsibilities and limitations of authority as agreed to by Architect in writing and as are set forth in the construction contract documents for the Project. However in the event of conflict, dispute, or discrepancy between the provisions of this Agreement and the construction contract documents, the more restrictive and/or burdensome will govern and control. ARTICLE 14 BASIS OF COMPENSATION 14.1 The City will compensate the Architect, in accordance with Article 5, Payments to the Architect, and the other terms and conditions of this Agreement, as follows: 14.2 The total fee to be paid to Architect for Basic Services as described in Sections 1.1 through 1.4 will be $16,100.00. This compensation is divided among the Basic Services tasks as follows: TASK 1 - PRELIMINARY DESIGN SERVICES (5%) $ 805.00 TASK 2 - DESIGN SERVICES (70%) 11,270.00 TASK 3 - BIDDING AND CONSTRUCTION CONTRACT ADMINISTRATION (25%) 4.025.00 TOTAL FEE: $16,100.00 Compensation for additional services of qonsultants, including additional structural, mechanical and electrical engineering services shall be billed by Architect to the City at actual Cost. 14.3 Compensation for additional services of the Architect, as described in Section 1.5, shall be computed based on the Architect's standard hourly rates: Principal Intern Architect/Designer Clerical $ 70.00 $ 45.00 $ 21.00 This Agreement will be effective as of the day and year executed by the City. 13
