<br />148 <br /> <br />RULES OF OPERATION AND PROCEDURE FOR EDWARDS SUPPLY <br />(the ROPES) <br /> <br />The following Rules of Operation and Procedure for Edwards Supply (ROPES) are <br />adopted by the Management Council of the Regional Water Resource Development <br />Group (RWRDG) pursuant to Section 3.2(e) of the certain Interlocal Agreement and are <br />approved by the individual RWRDG participants pursuant to Section 3.2(f) of the <br />Interlocal Agreement. <br /> <br />Section 1. Definitions <br /> <br />Account- Deposits with banks or other financial institutions. <br /> <br />Administrator- The entity or individual charged with certain duties pursuant to Section 4 <br />of the Interlocal Agreement. <br /> <br />Agent- The entity or individual charged with certain duties pursuant to Section 5 of the <br />Interlocal Agreement. <br /> <br />Aggregate Demand- The collective demand determined semiannually of RWRDG <br />participants for Edwards Aquifer groundwater withdrawal rights. <br /> <br />Agricultural Land- Real property with associated groundwater withdrawal rights defined <br />by the EAA as agricultural in nature. <br /> <br />Critical Period- A time period of drought characterized by reduced Edwards Aquifer <br />levels as defined by the EAA or other regional or local government. <br /> <br />Edwards Aquifer Authority ("EAA '')- The public agency established by statute to <br />manage the Edwards Aquifer and to permit groundwater withdrawal rights. <br /> <br />Edwards Aquifer Groundwater Withdrawal Rights- The legal right to withdraw Edwards <br />Aquifer groundwater based on recognition of that right by the EAA. <br /> <br />Fund- A fiscal and accounting entity with a self-balancing set of accounts in which cash <br />and other financial resources, all related liabilities and residual equities, or balances, and <br />
