<br />Section 19. Annual RWRDG Participation Fee <br /> <br />Each RWRDG participant shall pay to the Administrator the sum of One Hundred <br />Dollars ($100.00) for an annual participation fee, which shall become part of the <br />RWRDG operating fund. The annual participation fee will be credited back if a RWRDG <br />participant's nonrefundable administrative charge exceeds $100.00. <br /> <br />Section 20. Assumption by RWRDG of Prior Edwards Aquifer Groundwater <br />Withdrawal Rights Acquisitions by Individual RWRDG Participants <br /> <br />All Edwards Aquifer groundwater withdrawal rights acquisitions made by individual <br />RWRDG participants and potentially transferable to the RWRDG pursuant to Section <br />2.2(g) of the Interlocal Agreement may be rejected by the Management Council should <br />those acquisitions fail to conform to the acquisition strategy categories or target prices <br />established by the Management Council. If a groundwate.r withdrawal rights acquisition <br />made by an individual RWRDG participant is rejected, the amount of groundwater <br />withdrawal right in the rejected acquisition would be subtracted from the amount of <br />groundwater withdrawal rights eligible to be acquired in the appropriate priority category. <br /> <br />Section 21. Acquisition of Edwards Aquifer Groundwater Withdrawal Rights <br />Associated with Agricultural Land <br /> <br />The R WRDG acting through its Agent shall be empowered to acquire agricultural land <br />with associated Edwards Aquifer groundwater withdrawal rights and to sever the <br />maximum amount of groundwater withdrawal rights from the land permissible under law <br />and EAA regulation. Such severed groundwater withdrawal rights shall be allocated in <br />the fashion generally provided herein for allocation of acquired groundwater withdrawal <br />rights among R WRDG participants. <br /> <br />Section 22. Sale of Agricultural Land and Residual Edwards Aquifer Groundwater <br />Withdrawal Rights to Individual RWRDG Participants <br /> <br />If the R WRDG acquires agricultural land with groundwater withdrawal rights and severs <br />the maximum legally permissible groundwater withdrawal rights as provided herein, the <br />residual land and any residual groundwater withdrawal rights which by law or regulation <br />must remain with the land shall be offered for sale to all R WRDG participants. However, <br />no individual R WRDG participant shall ever be required to purchase agricultural land <br />from the RWRDG by operation of these ROPES. The Administrator will canvas the <br />R WRDG participants for their willingness to purchase the residual agricultural land and <br />groundwater withdrawal rights. If no RWRDG participant desires to purchase the <br />agricultural land and residual groundwater withdrawal rights as provided in Section 21 <br />herein, the RWRDG shall not acquire the agricultural land. <br /> <br />\ \COSER VER\DA T A \LEGWP\PBB\ACQUISIT\ropes.j99.doc 8 <br />
