<br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAl'1 j\.L-\.RCOS,
<br />TEXAS, APPROVING, RATIFYING Ai'jD COl'lrIRi"1ING PUBLICATION OF
<br />NOTICE OF INTENTION TO ISSUE REVENUE BONDS
<br />
<br />WHEREAS, on January II, 1999, the City Council (the "City Council") of the City of San Marcos,
<br />Texas (the "City") adopted a resolution directing publication of notice of the City's intention to issue, on
<br />February 8, 1999, revenue bonds of the City in the maximum principal amount of$6,300,000, for the public
<br />purpose of acquiring, constructing and installing additions, improvements and extensions to the
<br />City's waterworks and sewer system;
<br />
<br />WHEREAS, on February 8, 1999, pursuant to said reso lution, the City Council adopted an ordinance
<br />authorizing the issuance and awarding the sale of the revenue bonds of the City entitled "City of San Marcos,
<br />Texas, Waterworks and Waste Water System Revenue Bonds, Series 1999, in the aggregate prine ipal amount
<br />of $6,300,000, for the aforesaid purpose;
<br />
<br />WHEREAS, subsequent to the adoption of said ordinance, it was determined that the newspaper in
<br />which notice of the City's intention to issue such revenue bonds was to have been published had failed to
<br />publish such notice;
<br />
<br />WHEREAS, upon discovery of such failure of publication, the City Secretary of the City delivered
<br />to said newspaper notice of the City's intention to authorize the issuance of such revenue bonds at the
<br />meeting of the City Council to be held on March 1, 1999, a copy of such notice being attached hereto as
<br />Exhibit A; and such notice was published in such newspaper on February 11, 1999, and February 18, 1999;
<br />
<br />WHEREAS, the City Council finds and determines that it is necessary and to the best interests of
<br />the City to approve, ratify and confirm publication of such notice on February 11, 1999, and February 18,
<br />1999; Now, Therefore
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SA1'l" rvfARCOS:
<br />
<br />Section 1. Findings.
<br />
<br />The statements contained in the preamble of this Resolution are true and correct and are adopted
<br />hereby as findings of fact and operative provisions hereoffor all purposes.
<br />
<br />Section 2. Publication of Notice Aporoved. Ratified and Con finned.
<br />
<br />The publication of notice of the City's intention to issue revenue bonds February 11, 1999, and
<br />February 18, 1999, as described in the third paragraph of the preamble of this Resolution is hereby approved,
<br />ratified and confinned in all respects and for all purposes.
