<br />I <br /> <br />I <br /> <br />I <br /> <br />a) Any environmental effort beyond initial coordination, such as <br />wetland/jurisdictional waters determinations, habitat evaluations, environmental <br />assessments, or specific environmental permits from USFW, TCEQ, U.S Army Corps <br />of Engineers or other regulatory agencies. <br />b) Costs for engineering and construction necessary to relocate utilities not borne by <br />the utility provider. <br />c) Efforts expended by the Engineer in obtaining permits/approvals from UP in <br />excess of the amount allotted under this Agreement. <br />d) Drainage analyses in excess of that limited to extension of existing culverts <br />and/or relocation of ditches of comparable capacity to existing ditches. <br />e) Additional public outreach efforts or public notifications beyond meetmgs noted <br />m this Agreement. <br />f) Profiles for sidewalks along existing streets. Profiles will be provided only for <br />areas that deviate from the existing roads. Drawings prepared outside of identified <br />plan views and typical sections are additional services. <br />g) Attendance at additional meetings not already identified in this Agreement, as <br />requested by the City. <br />h) Any effort expended by the Engineer related to the acquisition of additional <br />right-of-way, easements or property. <br />i) The new pedestrian elements included in the project work at these three locations <br />will comply with ADA/Texas Department of Licensing and Regulation requirements. <br />However, any efforts to modify or add improvements at adjacent facilities for <br />accessibility or other reasons will be considered an additional service. <br />j) The Engineer will diligently pursue timely permits and approvals from TxDOT, <br />UP and other agencies. However, delays in such permits and approvals due to <br />external schedules will result in changes to proposed schedules. <br />k) Any effort expended by the Engineer in developing a formal Environmental <br />Assessment or evaluation to comply with the National Environmental Policy Act for <br />the Proj ect. <br /> <br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br /> <br />The City will: <br /> <br />2.1 Provide full information to the Engineer regarding the City's requirements for the <br />Engineer's services under this Agreement. The City will furnish the Engineer with copies of <br />official City design standards and construction standards, and other data and information in the <br />City's possession needed by the Engineer at the Engineer's request. <br /> <br />2.2 Designate Richard Mendoza, Director of Public Works as the City's Project Manager and <br />authorized representative to act on the City's behalf with respect to this Agreement. The City <br />will examine the documents and information submitted by the Engineer and promptly render <br />responses to the Engineer on issues requiring a decision by the City. <br />Klotz Engineering <br /> <br />10 <br />
