INTERLOCAL AGREEMENT <br />FOR ARCHEOLOGICAL SERVICES <br /> <br />91. <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br /> The City of San Marcos ("San Marcos") and Southwest Texas State University ("SWT") <br />enter into this Interlocal Agreement under the authority of the Interlocal Cooperation Act, Chapter <br />791 of the Texas Government Code, as.amended. <br /> <br /> 1. The City agrees to engage SWT to perform archeological surveys and site assessments <br />for the City on a per-project basis. SWT agrees to perform these services in generaI conformity with <br />the Scope of Work attached to this Agreement as Attachment A. Upon request of the City with <br />respect to each project, SWT will prepare a project-specific scope of work and a cost estimate for <br />City approval. Upon receipt of the City's approval, SWT will proceed to perform the work. <br /> <br /> 2. The City agrees to pay SWT a totainot-to-exceed amount of$150,000.00 for services <br />provided under this Agreement. SWT will submit project-specific invoices to the City which will <br />be based on hourly rates as described in Attachment B. The City will make payment within 30 days <br />of its receipt of an invoice from SWT. The total of all fees charged by SWT will not exceed <br />$150,0.00.00 without prior written authorization by the City. <br /> <br /> 3. The City and SWT acknowledge that the City's payments :for the services performed <br />under this agreement will be made from cun'ent revenues available to the City, and that the City's <br />payments under this agreement are in an amount that will fairly compensate SWT for these services. <br /> <br /> 4. Neither party may assign this Agreement without the written consent of the other <br />party. <br /> <br /> 5. This agreement will continue in force and effect unless and until one party notifies <br />the other of its intent to terminate this agreement with at least 30 days' advance written notice. <br /> <br /> 6.
